Information note on the protection of the personal data of prospective employees of Club med company

The company Club Med SAS (hereinafter “Club Med” or “we”), its subsidiaries and its partner companies that own managed Club Med villages attach great importance to the protection of your personal data and take great care to ensure compliance with European and French laws and regulations on the protection of privacy and the processing of personal data, as well as with the recommendations of its supervisory authority (hereinafter “the Applicable Legislation”).

To this end, Club Med has internal policies for the protection of personal data and the security of information systems for all employees who process such data.

Club Med undertakes to guarantee the integrity and reliability of the data entrusted to it, in particular by taking all necessary physical, organisational and logistical measures to prevent any alteration or destruction of said data, in particular by ensuring secure access only to persons authorised to process it.

As the data controller, Club Med (a French simplified joint-stock company, registered under number 572 185 684 with the Paris Trade and Companies Register and the registered office of which is located at 11 rue de Cambrai 75019 Paris) informs you through this information notice, of the use that is made of your personal data and of your rights.

This information notice applies to personal data from the various channels you use in connection with recruitment or an application, including
• all the Websites, sub-domains, applicant areas and intranets as well as all other online recruitment activities of the company Club Med SAS
(hereinafter the “Websites”). A full list of the websites concerned is available in Annex 1.
• correspondence related to recruitment or an application.
• interviews you may have with the teams involved in matters related to recruitment or an application.

This notice does not apply to third-party Websites, including those accessible via a web link.

Who are the natural persons concerned by this information notice?

This information notice applies to:
• applicants;
• any user of the Websites.

Unless indicated otherwise, the persons mentioned below are referred to as “you” in this information notice.

1 What personal data does Club Med collect?

1.1 Personal data that you provide directly to us or that has been provided to us

You provide us with personal data directly, including:
• when you fill in various forms/questionnaires on the Websites;
• when you create your applicant space on the Websites;
• when you contact our recruitment department.

In addition, where you have consented, third parties may provide us with personal data about you.

 In order to process your application and/or manage the applicant pool, Club Med may process various types of personal data, including that relating to:
• identification (civil status, contact details, photograph, user name, etc.);
• professional life (CV, training, degrees, career path, skills, qualifications, etc.);
• personal life (any type of declarative data communicated spontaneously and in direct connection with your application);
• images obtained via video surveillance devices (when you visit our premises);
• information published about you on social media (LinkedIn, JobTeaser...).

You must ensure that your personal data is accurate. In the event that an update of your personal data is necessary and you cannot do it yourself, please inform us thereof (see article 7.3).

Furthermore, Club Med SAS undertakes to collect only the personal data that is necessary for the purpose of the processing concerned.

You may choose, without any consequences for the proper handling of your file, not to provide us with certain information that is not compulsory (compulsory information is identified by an asterisk).

1.2 Types of data collected automatically

When you browse the Recruitment Websites, Club Med may collect, in strict compliance with the Applicable Legislation and your rights, data relating to:

• the characteristics of the operating system, browser or devices (computer, tablet, smartphone) that you use to access our services;
• your location such as your IP address;
• your browsing patterns and your interactions with the content of these Websites, such as the pages you visit, the search terms you use,
and the frequency of your visits to these Websites.

We primarily use cookies to recognise you when you log back into our Websites and services and to display content that is likely to match your interests.

In this case, you are informed, prior to the collection of your data, of its purpose and of your rights, in particular via a cookie banner.

 

2. For what purposes is your personal data used and what are the legal bases?

 Your personal data is used for the management of specific matters related to the recruitment or an application. Your personal data is always processed on one of the following legal bases: contractual performance (pre-contractual measures), consent, statutory obligation or legitimate interest.

2.1 The purposes for which your data is collected

To measure the audience of the Website, by analysing the number of pages viewed, the number of visitors to the Website, their activity on the Website, etc.
Customisation of recruitment To personalise our responses and, more generally, the services we offer you, as well as the information we may send you (newsletter, satisfaction surveys, offers that may be of interest to you, Club Med’s presence at events related to recruitment, launch of recruitment campaigns, etc.)

The information that may be sent to you electronically will never be commercial emails, the purpose is only to send you information related to employment with Club Med. You may opt out of receiving such messages by using our Preferences Centre at the bottom of the page.

3. What cookies are used by Club Med?

3.1 What is a cookie?

When you use the Websites and subject to your consent, Club Med may place a file called a “cookie” on your terminal (e.g., computer, tablet) through your browser. As long as it is saved, it allows your computer to be identified for your future visits. Thus, each time you visit the Websites, Data from your previous visit may be retained


3.2 What cookies does Club Med use?

Club Med uses, in particular, the cookies listed in Annex 2 hereof.

The functional cookies we issue allow us to:
• adapt the presentation of our Websites to your terminal’s display preferences (language used, display resolution, operating system used, etc.);
• make your searches easier by keeping your automatic searches;
• improve your user experience by pre-filling certain fields in our forms.

Analytical cookies allow us to improve our services by establishing statistics and volumes of traffic and use (sections and content visited, pathways, etc.).

With your prior consent, we automatically receive and store information from your computer and browser on:
• your IP address;
• your geographical area;
• the material used;
• the page visited;
• the actions carried out on the website.

We use recognised tools such as Google Analytics to collect statistics on user behaviour.


3.3 Your choices regarding cookies

It is important to note that any settings you select may affect the way in which you browse the Internet and your access conditions to certain services that require the use of cookies.

If you do not want these cookies to be saved on your terminal, or if you delete the cookies saved on your terminal, you will no longer be able to benefit from a number of functionalities that may be necessary to browse certain areas of our Websites.

4. How long is your personal data stored?

In general, your personal data is kept and accessible to authorised persons only for the time necessary to carry out the operations for which it was collected (see Article 2 of the information notice). At the end of these periods, your personal data will be destroyed. However, as an exception, some of it may be archived in accordance with the statutory periods in force.

If you have agreed to this, you can join our applicant pool. Your personal data will then be kept for a maximum period of two years from the last contact from you.

By joining this pool, our recruitment teams who may have vacancies matching your profile will be able to consult your file and contact you at any time. Furthermore, you can apply again on our Websites, either for the same type of position if your skills have progressed, or for other offers better suited to your profile.

If your application is successful and you are offered a position, your personal data will be processed in accordance with the rules applicable to our employees.

Any data collected via the audience measurement tools are kept for a maximum of 13 months from the last browsing of the user.

 

5. What are the categories of recipients of your personal data?

We may share your personal data with:

• the Human Resources departments of our subsidiaries and partner companies that own managed villages,
which are also subject to the provisions described in this information notice;

• our suppliers and/or subcontractors who process your data on our behalf, according to our instructions, for the purposes set out in Article 2.
We take particular care to ensure that these third parties provide adequate safeguards for the protection and security of your personal data;

• in the event that you are hired, the administrations and corporate bodies that must be informed in application of statutory or regulatory obligations.

 

6. Will your personal data be transferred outside the European Union?

We may transfer your personal data to countries outside the European Union for the sole purposes described in this information notice.

For each of these transfers, we ensure that your personal data benefits from a level of protection equivalent to that offered in the European Union.

Transfers are only made to countries that are recognised by the European Commission as providing an adequate level of data protection.

In the event that data is transferred to a country that does not offer an adequate level of protection, Club Med and its subsidiaries, partners or service providers undertake to transfer your personal data in strict compliance with the Applicable Legislation and, if necessary, to set up the transfer with appropriate guarantees (such as the signing of the European Commission’s standard contractual clauses), which you may request by letter sent to the address mentioned in article 7.3 below.

 

7. Your rights to your Personal Data

7.1 Your rights of access, rectification, deletion and objection.

You have several rights over your personal data, including

a right of access: you can obtain confirmation from Club Med SAS as to whether or not it holds personal data about you.

a right of rectification: you can correct inaccurate personal data or complete it in relation to the purpose of the processing.

a right to erasure: you may request the erasure of your personal data in certain specific cases provided for by law and within the limits of the Data Controller’s statutory obligations.

a right to object: you may object to the processing of your personal data on the basis of your situation if the processing is based on the legal basis of legitimate interest and within the limits of the Data Controller’s statutory obligations.

a right to portability of your data. 

 These rights can only be exercised insofar as they do not prevent the proper performance of the contract between you and Club Med SAS or one of its entities. 


7.2 Setting guidelines on what to do with your personal data

You have the right to define general or specific directives relating to the conservation, deletion and communication of your personal data post-mortem.

8. Revision of the information notice

Club Med may amend this information notice, in particular if the Applicable Legislation changes. Any changes will be posted on this page.
